“Win a Pool” Giveaway — Official Rules

Effective July 29, 2026

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. BOTH METHODS OF ENTRY ARE FREE.

A MINIMUM OF 5,000 QUALIFYING ENTRANTS IS REQUIRED FOR A DRAWING TO OCCUR. IF THE MINIMUM IS NOT REACHED, SPONSOR MAY, IN ITS SOLE DISCRETION, ELECT TO CONDUCT THE DRAWING ANYWAY; IF SPONSOR DOES NOT SO ELECT, NO PRIZE WILL BE AWARDED.

By entering, each entrant agrees to be bound by these Official Rules and Sponsor’s decisions concerning the administration of the Giveaway, which are final and binding in all matters.

1. Sponsor

The “Win a Pool” Giveaway (“Giveaway”) is sponsored by Golden Hour Pools, LLC, 1705 Hether St, Austin, Texas 78704 (“Sponsor”).

2. Eligibility

The Giveaway is open only to legal residents of Texas who are at least 18 years old at the time of entry.

Employees, officers, contractors, and representatives of Sponsor, its affiliates, and its advertising or promotion agencies, and members of their immediate families or households, are not eligible. “Immediate family” includes spouses, parents, children, siblings, and their respective spouses.

To receive the Prize, the winner must own, or obtain all required owner authorization for, an eligible residential property located in Texas.

No purchase, payment, deposit, consultation, sales appointment, or marketing consent is required to enter or win, and none will improve your odds.

Void where prohibited by law.

3. Entry period and minimum entrant requirement

The Giveaway begins July 29, 2026, at 12:00 a.m. Central Time and ends September 30, 2026, at 11:59 p.m. Central Time (“Entry Period”).

At least 5,000 unique qualifying entrants (counting each person once, whether they enter by one or both methods) must enter during the Entry Period before a drawing will occur.

If the minimum is not reached by the end of the Entry Period, Sponsor may, in its sole discretion, elect to conduct the drawing anyway. This election benefits entrants only: it can result in a drawing that would not otherwise occur, and it does not change the entry methods, the odds among entries received, the Prize, or any other term of these Official Rules. If Sponsor does not so elect, no winner will be selected and no Prize will be awarded.

Sponsor will announce whether the drawing will occur on or about October 3, 2026, on Sponsor’s Instagram account (@goldenhourpools) and at goldenhourpools.com/giveaway.

Sponsor will not extend the Entry Period.

Sponsor’s entry records (described in Section 6) will be used to determine whether the minimum has been satisfied, subject to removal of duplicate, automated, fraudulent, incomplete, or otherwise ineligible entries.

4. How to enter

There are two free ways to enter. You may use one or both. Each method earns one entry; the maximum is two entries per person.

Method A — Comment on Instagram. During the Entry Period, leave one comment on the designated Giveaway post on Sponsor’s Instagram account (@goldenhourpools) telling us who you’d spend your first pool day with. A Method A entry also requires, from the same Instagram account: liking the Giveaway post; following @goldenhourpools; and sharing the Giveaway post to your Instagram Story or feed. One comment, together with these requirements, counts as one entry. Additional comments, replies, or comments from additional accounts do not create additional entries. Comments that are off-topic, abusive, or automated may be disqualified. The like and follow must remain in place through winner verification, and entrants should keep proof of their share (a screenshot is fine; your Story archive retains expired Stories). Section 9 describes how these requirements are verified.

Method B — Enter on our website. During the Entry Period, complete and submit the official entry form at goldenhourpools.com/giveaway, then confirm your email address using the confirmation link Sponsor emails you. An entry by this method is complete when the email address is confirmed. One confirmed form counts as one entry. Additional submissions, email addresses, phone numbers, identities, or accounts do not create additional entries.

Liking, following, and sharing are required only as part of a Method A entry. None of them is required to enter or win by Method B, none of them creates an entry by itself, and completing them does not affect your odds.

If you enter by both methods and provide your Instagram username on the form, Sponsor will associate the two entries with you; you still have at most two entries.

5. Entry data and Instagram

By entering through Method A, you agree that Sponsor may collect, export, and store your Instagram username, user ID, the content and timestamp of your comment, and publicly available profile information, using Instagram’s platform and tools, and may combine that information with entry-form data in Sponsor’s systems for the purposes of administering the Giveaway, verifying entries, conducting the drawing, contacting the potential winner, preventing fraud, and maintaining the records described in these Official Rules.

Sponsor is not responsible for comments that are deleted, edited, hidden, or otherwise unavailable at the time Sponsor records entries. Entrants are responsible for keeping their comment posted, their like and follow in place, and their account accessible, through the winner-verification process, and for retaining reasonable proof of their share; entrants with private accounts may be asked to verify their entry.

6. Entry records and the drawing method

Sponsor administers the Giveaway using its own systems, not a third-party sweepstakes vendor.

Method A entries are recorded from Instagram’s official data tools as timestamped snapshots during and at the close of the Entry Period. Method B entries are recorded in Sponsor’s entry ledger at the time of submission and confirmation. Instagram does not provide entrant-level data or timestamps for likes, follows, or shares, so those requirements are not part of these records and are verified manually as described in Section 9.

After the Entry Period closes, Sponsor will: (1) compile the final list of qualifying entries, with duplicate, ineligible, automated, and fraudulent entries removed; (2) fix the list in a final entry file and compute a cryptographic fingerprint (SHA-256 hash) of that file, which is preserved before the drawing; and (3) select the potential winner (and alternates, in order) at random from the final list using a cryptographically secure random number generator, in a recorded session with at least one witness who is not the operator. The final entry file, its fingerprint, the recording, and the selection record will be retained for at least four years.

7. Prize

One verified winner will receive one standard Golden Hour Pools Classic (“Classic”) gunite pool, installed at one eligible residential property located in Texas (“Prize”). Approximate retail value: $60,000.

The Prize includes: one approximately 12-foot-by-22-foot gunite pool; Sponsor’s standard Classic depth configuration; standard Lueder stone coping; standard micro-pebble plaster; Sponsor’s standard Jandy equipment package; standard site plans and permitting; standard excavation and pool construction; standard plumbing, electrical, bonding, coping, and finishing required for the pool; pool startup and initial water balancing; and one month of standard professional pool cleaning.

The Prize includes only Sponsor’s standard Classic pool package. No upgrades, add-ons, or custom work are included. Excluded items include, without limitation: tanning ledge; heater; chiller; saltwater upgrade; waterline-tile upgrade; fountain or water feature; deep-end bench; lighting package; spa or hot tub; custom dimensions or shape; infinity or perimeter edge; landscaping; decking or additional concrete flatwork; hardscaping; fencing; irrigation work; retaining walls; utility relocation; major drainage or grading work; tree removal; rock excavation; soil remediation; and nonstandard engineering or structural work.

Sponsor may substitute unavailable equipment or materials with reasonably comparable equipment or materials of similar quality and value.

Winner-requested upgrades may be purchased separately only if approved by Sponsor in writing. No purchase or upgrade is required to receive the standard Prize.

The Prize is non-transferable and may not be exchanged for cash, credit, another pool size, work at a different property, or other goods or services.

8. Property ownership and site feasibility

Installation is conditioned on Sponsor confirming that the proposed property qualifies for Sponsor’s standard Classic pool construction process.

The potential winner must either be the legal owner of the proposed installation property or provide written authorization from every legal property owner whose consent is required.

The proposed property must: be located in Texas; have adequate space for the Classic pool; have adequate setbacks and no disqualifying easement conflicts; have reasonable access for standard excavation and construction equipment; have a relatively flat yard; not require retaining walls, substantial grading, utility relocation, or unusual drainage, structural, or engineering work; not present abnormal rock, soil, groundwater, or excavation conditions; be capable of receiving applicable governmental permits and any required HOA or architectural approvals; and otherwise fall within Sponsor’s standard construction scope.

Sponsor may require a property survey, photographs, ownership records, HOA information, utility information, and an on-site evaluation. Sponsor will make the feasibility determination reasonably and in good faith based on its standard construction requirements.

If the potential winner or proposed property does not satisfy these requirements, Sponsor may disqualify that potential winner and select an alternate. A disqualified potential winner will not receive cash, credit, reimbursement, a substitute prize, or other compensation.

9. Winner selection and odds

Provided the requirement in Section 3 is satisfied (or Sponsor elects to proceed under Section 3), Sponsor will conduct the drawing described in Section 6 on or about October 3, 2026, at Sponsor’s office at 1705 Hether St, Austin, Texas.

The selected entrant is a potential winner only until Sponsor verifies: completion of a qualifying entry (including, for a Method A entry, the required like); eligibility; identity, age, and Texas residency; property ownership or required owner authorization; property and site feasibility; and completion of all required documents.

Because Instagram does not report entrant-level data or timestamps for likes, follows, or shares, Sponsor verifies these requirements manually rather than at the moment the Entry Period closes, and only for selected potential winners and alternates. For a potential winner or alternate selected from a Method A entry: (1) Sponsor will check that the entrant’s like of the designated Giveaway post and follow of @goldenhourpools are in place at the time of verification, which may occur at any point during the winner-selection and verification process; and (2) the entrant must provide reasonable proof of their share of the Giveaway post — for example, a screenshot, including from the entrant’s own Story archive for an expired Story — in the same manner as the other verification materials described in Section 11. If the like or follow is not in place when Sponsor checks, or reasonable proof of the share is not provided within the response period in Section 10, Sponsor may disqualify that potential winner and select an alternate.

Odds of winning depend on the total number of qualifying entries received.

10. Winner notification

Sponsor will attempt to contact the potential winner through Instagram direct message from @goldenhourpools and, when available, the email address or phone number provided on the entry form. The potential winner must respond within five business days after Sponsor’s first notification attempt.

Beware of imposters. Sponsor will only ever contact entrants from the verified @goldenhourpools Instagram account or an @goldenhourpools.com email address. Sponsor will never ask an entrant to pay a fee, share payment or banking details, buy a gift card, or click a link to “claim” the Prize. Any such message is a scam and should be reported. The winner will be announced only on Sponsor’s Instagram account and at goldenhourpools.com/giveaway after verification is complete.

If the potential winner cannot be contacted; does not respond within the required period; cannot verify a qualifying entry (including, for a Method A entry, the required like, follow, and share); submitted false or incomplete information; is not eligible; does not own or have permission to use an eligible property; does not pass the site-feasibility review; declines the Prize; or does not timely complete the required documents, Sponsor may disqualify that person and select an alternate potential winner using the same recorded method, continuing until an eligible winner with a qualifying property is confirmed or all alternates are exhausted.

11. Verification and required documents

Before being confirmed as the winner, the potential winner may be required to provide: government-issued identification; proof of age and Texas residency; proof of property ownership or written authorization from all required property owners; for a Method A entry, reasonable proof of the required share; a property survey and site photographs; HOA information or approvals; an Affidavit of Eligibility; a liability and publicity release; a property-access and filming release; an IRS Form W-9 and other information legally required for tax reporting; and Sponsor’s applicable installation, construction, and warranty documents. The installation agreement will not require the winner to purchase anything to receive the standard Prize.

The potential winner must generally complete requested documents within ten business days, unless Sponsor provides a different written deadline.

12. Installation

Installation will be scheduled after the winner has been verified; the property has passed Sponsor’s feasibility review; required documents have been signed; required governmental permits have been issued; required HOA or architectural approvals have been obtained; and Sponsor is reasonably able to schedule construction.

Installation timing is subject to permitting, inspections, weather, labor availability, material and equipment availability, construction scheduling, and circumstances outside Sponsor’s reasonable control.

The winner and property owner must provide Sponsor and its contractors with reasonable access to the property for site evaluation, permitting, construction, inspections, startup, cleaning, photography, filming, and warranty-related work.

Construction and warranty matters will be governed by Sponsor’s written installation agreement and applicable warranty.

13. Taxes and other costs

The Prize’s approximate retail value is $60,000, and that value is taxable income to the winner. Sponsor will report the Prize to the IRS on Form 1099-MISC as required by law, and no tax withholding will be taken from a non-cash prize — the winner is solely responsible for all federal, state, and local taxes associated with the Prize, and for costs not expressly included in the standard Classic pool package. Sponsor encourages potential winners to consult a tax professional before accepting the Prize.

14. Privacy

Information collected through the entry form or winner-verification process will be used to administer the Giveaway; verify eligibility and entries; contact the potential winner; evaluate site feasibility; prevent fraud; install and document the Prize; and comply with legal obligations. Information will otherwise be handled in accordance with Sponsor’s Privacy Policy at goldenhourpools.com/privacy.

Entering does not sign you up for marketing. Any consent to receive promotional emails, texts, or calls is requested separately on the entry form, is entirely optional, and is not a condition of entry or winning.

15. Media and publicity

Except where prohibited by law, acceptance of the Prize constitutes the winner’s permission for Sponsor to use the winner’s name, image, likeness, voice, statements, city of residence, and information regarding the Prize for reasonable promotional, advertising, editorial, and publicity purposes without additional compensation.

The winner and all required property owners must permit Sponsor to reasonably photograph, film, and record: the winner; the exterior of the property; the pool site; the design and construction process; Sponsor’s employees and contractors working at the property; and the completed pool. Sponsor may edit, reproduce, publish, display, and distribute the resulting content in any media, worldwide and in perpetuity, without additional compensation or approval.

Sponsor’s access will be reasonably scheduled and limited to the pool project, exterior work areas, and agreed documentation activities. Sponsor will not publish the property’s exact street address without permission.

16. General conditions

Sponsor may cancel, suspend, delay, or modify the Giveaway if fraud, unauthorized intervention, technical failure, an Instagram or platform disruption, natural disaster, governmental action, or another event outside Sponsor’s reasonable control materially affects the fairness, security, or administration of the Giveaway. If the Giveaway is terminated early for such a reason, Sponsor will select the winner at random from qualifying entries received before the termination.

Sponsor may disqualify an entrant who violates these Official Rules; uses multiple identities or accounts; submits false information; uses automated or fraudulent entry methods; interferes with the Giveaway; or attempts to improperly influence the drawing or verification process.

Sponsor is not responsible for entries, comments, form submissions, emails, direct messages, or notifications that are lost, late, incomplete, deleted, inaccessible, corrupted, or affected by technical or platform errors. If Sponsor’s Instagram account becomes unavailable during the Entry Period, the website entry method remains available and the Giveaway continues.

17. Release and limitation of liability

To the fullest extent permitted by law, entrants release Sponsor, its affiliates, officers, directors, employees, contractors, agents, and promotion administrators from claims arising from participation in or administration of the Giveaway, entry-processing errors, platform failures, failure to receive notification, or an entrant’s failure to comply with these Official Rules.

This release does not waive rights that cannot legally be waived, and does not eliminate construction, workmanship, warranty, or other obligations expressly accepted by Sponsor under the applicable installation agreement and warranty.

18. Instagram disclaimer and release

By entering, each entrant completely releases Instagram and Meta Platforms, Inc. from any responsibility or liability relating to the Giveaway. The Giveaway is in no way sponsored, endorsed, or administered by, or associated with, Instagram or Meta Platforms, Inc. Entrants are providing their information to Sponsor and not to Instagram.

19. Governing law

The Giveaway and these Official Rules are governed by the laws of the State of Texas. Any legal proceeding relating to the Giveaway must be brought in a court of competent jurisdiction located in Travis County, Texas, unless applicable law requires otherwise. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
